North Charleston Drug Charges Defense Attorney
If you face drug charges, including drug trafficking, prescription drug violations, or the possession, distribution, manufacture or cultivation of narcotics, you may feel like you face certain conviction and punishment. Narcotics cases, however, often involve mistaken identity, questions as to ownership of confiscated drugs, violations of police procedures and other factors that can lead to dismissal of charges or a reduced sentence.
At the Law Offices of J. Michael Bosnak, we have a long track record of winning cases for clients facing narcotics charges. Several recent cases included the following scenarios and issues of law:
- A drug dealer and a police "nark" were in one car and our client was allegedly in another car. Cocaine was exchanged. Neither the dealer nor the nark could firmly identify our client as the recipient of the drug, and our client's name was never mentioned during the deal. Our client's car, however, was identified. Our client originally faced a 25-year prison sentence. Through our defense, he is currently serving a six-year term, which may be reduced.
- Our client encountered a police roadblock while approaching his apartment complex. Through a misunderstanding, our client fled the scene and jumped over a nearby fence. Police then found crack cocaine and a pistol on the other side of the fence. We argued that the roadblock was illegal and that the police could not prove the pistol and drugs belonged to our client. All charges were dismissed.
- Our client was a wealthy black man. A white man allegedly regularly obtained drugs with the assistance of our client. Police arrested the white man for drug charges but, rather than prosecute him, promised to suspend his charges if he helped them set up our client on drug charges. Through our defense, our client served 10 months in a juvenile facility rather than the six to 15 months in prison he originally faced.
